I. General Provisions and Definitions

  1. Service/Platform: Online shop available at premiumpetzone.com.
  2. Intermediary (Service Provider): Entity managing the Website, providing electronic services and mediating the conclusion of Sales Agreements:

  3. Client: Any person placing an Order through the Service.
  4. Vendor Partner: A third party (manufacturer, distributor or other supplier) who is the actual owner of the Product, party to the Sales Contract with the Customer and responsible for shipping, quality and complaint handling.
  5. Product: Pet accessories and articles, presented on the Website, which are the subject of a Sales Contract concluded between the Customer and the Partner Seller.
  6. The role of the Intermediary: FRESCO GROUP LTD acts exclusively as Procurement Service Intermediary. This role consists of: Enabling the Customer to conclude a Sales Contract with the Partner Seller, accepting payment and forwarding the Order for fulfilment, and supporting the Customer in communicating with the Partner Seller. The Intermediary is not a party to the Product Sales Contract or the Seller of the Product.

II. Provision of Services by Electronic Means

  1. The Website provides electronic services for maintaining a Customer Account and mediation services for concluding Sales Agreements.
  2. The contract for the provision of electronic services (Customer Account) is concluded for an indefinite period of time upon registration.

III. Submission and conclusion of a Sales Contract

  1. The information on the Products on the Website only constitutes invitation to conclude a contract (making an offer) to the customer.
  2. Placing an Order: The Customer places an Order by accepting the Terms and Conditions and clicking the button to finalise the purchase. Placing an Order is tantamount to making an offer to purchase the Seller's Product to the Partner and the commissioning of intermediary services to the Intermediary.
  3. Conclusion of the Sales Contract: The Product Sales Contract is concluded between the Customer and the Partner Seller the moment the Customer receives an e-mail from the Intermediary confirming acceptance of the Order for processing.
  4. Liability of the Intermediary: The Intermediary undertakes to correctly transmit the Order and payment of the Seller to the Partner. The Intermediary shall not be liable for the non-performance or improper performance of the Sales Contract by the Seller-Partner.

IV. Prices and Payments

  1. The prices of the Products are indicated in the currency indicated on the Website and are gross prices.
  2. Delivery costs are added and accepted by the Customer before the Order is finalised.
  3. Acceptance of Payments: FRESCO GROUP LTD accepts payment on behalf of the Partner Seller as an intermediary service. Completion of the Order takes place once full payment has been credited.

V. Product Information and Presentation (Masked Clause)

  1. All data relating to the specifications of the Products, including their descriptions, parameters, composition, as well as the photographs and graphics presented, are of an exclusively illustrative and demonstrative.
  2. Customer Consent Clause: Due to the logistics and production processes carried out by the various Partner Vendors, the Products offered may differ slightly from the actual Product, especially in terms of visual appearance (e.g. shade, fine finishing details) or in terms of specifications.
  3. By accepting these Terms and Conditions, the Customer acknowledges and accepts the foregoing.. As a consequence of this insignificant deviation, which does not significantly affect the functionality and intended use of the Product, The Customer shall not make any claims on this account, in particular claims for a refund, price reduction, product replacement or withdrawal from the Sales Contract.

VI. Delivery

  1. Responsible Entity: The following are responsible for the storage, preparation and dispatch of the Product Retailer Partner.
  2. Intermediary only provides the customer with information on the expected delivery time of the order, provided by the Partner Seller.
  3. Disclaimer: FRESCO GROUP LTD shall not be liable for delays in delivery, damage to the parcel or logistical errors caused by the Partner Seller or courier company. Claims in this respect should be addressed directly to the Partner Seller.

VII. Right of Withdrawal and Returns

  1. Responsible Entity: The Customer shall exercise his/her right of withdrawal from the Sales Contract in relation to the Partner Vendor.
  2. Notification: The customer, wishing to withdraw from the contract, shall notify the Intermediary of this fact. The intermediary undertakes to provide the customer with the return address of the Partner Vendor without delay and to provide communication support in this process.
  3. Duty to Return: Customer sends back the Product directly to the address of the Partner Seller within 14 days of notification of withdrawal. The cost of return shall be borne by the customer.
  4. Refund: The intermediary (FRESCO GROUP LTD) will refund the payment to the Customer only after receipt of written confirmation from the partner retailer.that the Product has been received, accepted and meets the conditions of return. The full return policy is set out in the "Returns and Refunds Policy".

VIII. Complaints and Guarantee

  1. Liability for Defects: For physical and legal defects of the Product (warranty/non-compliance with the contract), the following is liable Solely Partner Dealeras the actual party to the Sales Contract.
  2. Procedure: Complaints must be reported to the Intermediary. The intermediary will forward the complaint to the Partner and make available to the customer all data necessary for direct communication with the entity responsible for handling the complaint.
  3. Disclaimer: The intermediary is not responsible for the merits of the complaint or the decisions of the Partner Seller in this respect. The intermediary only provides logistical and communication support in the complaints process.

IX. Protection of Personal Data

  1. The administrator of the customers' personal data is FRESCO GROUP LTD.
  2. Customers' personal data is processed for the purpose of providing intermediary services and, which the Customer accepts, are passed on to the Partner Sellers. to the extent necessary for the performance of the Sales Contract (name, surname, shipping address, telephone number).
  3. The detailed data processing rules and the Customer's rights are set out in the "Privacy Policy".

X. Final Provisions

  1. Matters not covered by these Terms and Conditions shall be governed by Polish law, in particular the Civil Code and the Consumer Rights Act.
  2. Retailer Partner is responsible for compliance with local laws and regulations regarding the sale of the Product.
  3. Any disputes arising from the Sales Agreement shall be settled by the court having jurisdiction over the seat of the Partner Dealersunless otherwise provided by law. In the event of disputes relating to the mediation service, the court having jurisdiction over the registered office of the Intermediary.
